Terms and Conditions – Indemnity

I, the undersigned, acknowledge that the use of Zwartkops International Kart Raceway involves the use of, inter alia, karts, motorcycles, racing equipment and associated or ancillary activities which have an inherent danger involved in their use. Neither Zwartkops International Kart Raceway nor Max Challenge Promotions CC, their members and/or directors and/or employees and/or agents and/or all persons for whom they are, in law, responsible (collectively referred to as “the Organiser”) shall be responsible or may be held liable for any loss, damage or injury of whatsoever nature or cause, including consequential losses suffered or caused, to any person or property from the use of karts, motorcycles, racing equipment and associated or ancillary activities whether such loss, damage or injury is occasioned by any act or omission of the Organiser or by reason of force majeure, casus fortuitous, rain or other water, riots, strikes, theft or burglary (with or without forceable entry), or by reason of any condition during any activity at the Organiser’s premises or any building structure or any defective facilities rented by or used by the Organiser or caused by any activity carried on by the Organiser or by any cause of whatsoever nature and howsoever arising.

I shall, at all times, hold the Organiser indemnified against and harmless from and shall in no manner whatsoever seek to hold the Organiser liable for any injury, loss or damage suffered as a result of personal injury or patrimonial loss arising directly or indirectly from the participation of any person in the activities of the Organiser or any related activity or any other activity involving karts, motorcycles, racing equipment and associated or ancillary activities whether or not such injury, loss or damage can be attributed directly or indirectly to willfulness or negligence of whatsoever nature or degree on the part of the Organiser.

I acknowledge and understand that motor racing of any form is dangerous and could lead to serious injury or death. I knowingly and voluntarily accept those risks and the dangers involved. This indemnity shall be extended to the undersigned’s spouse, heirs, successors, representatives, agents and assignees the terms of which shall, mutatis mutandis, be applicable to them.
